While consensual divorce offers a streamlined path for couples where both spouses consent, traditional contested divorce remains the established legal route when one spouse withholds consent. This adversarial process ensures your rights are protected through formal court proceedings.

Legal Grounds for Divorce in Cyprus
Under Cyprus law, you must establish one of the following grounds to obtain a traditional divorce:
Irretrievable Breakdown
The marital relationship has broken down due to conduct making continuation unbearable
Separation
Spouses have lived separately for a continuous period of at least 2 years
Abandonment
One spouse has abandoned the other without justification
Other Grounds
Including adultery, violence, or other serious misconduct as defined by law
Civil and Religious Marriages
The procedural route depends on the type of marriage:
Civil Marriage
The divorce petition is filed directly with the competent Family Court; no prior formalities are required
Religious Marriage
The law requires prior written notification to the Bishop of the diocese where the marriage was celebrated; the petition may be filed only after the statutory conciliation period has passed

The Contested Divorce Process

- Petition Filing I prepare and file the divorce petition with the Family Court, setting out your claims and the grounds for divorce
- Service & Response The respondent is served with the petition and may file a defence within the time limit set by the court; if no defence is filed, the case proceeds as undefended and is concluded considerably faster
- Court Proceedings The case proceeds through hearings where evidence is presented, and the court determines the disputed matters
- Judgment & Decree Absolute The court issues its judgment dissolving the marriage; the decree becomes absolute 42 days after issue, once the period for filing an appeal has expired
If both spouses reach consent at any stage of the proceedings, the case can be converted into a consensual divorce, with substantial savings in time, cost, and emotional strain.
Divorce and Related Applications
The divorce petition itself has a single object: the dissolution of the marriage. Under Cyprus procedure, the matters below are pursued through separate applications before the Family Court, each following its own procedural track:
- Parental Responsibility and Custody
- Contact and Visitation Rights
- Child Maintenance Obligations
- Division of Marital Property
- Spousal Maintenance (where applicable)
In practice, these applications are coordinated as a single litigation strategy and are often filed in parallel with the divorce petition. Where circumstances demand immediate protection, the court may grant interim orders while proceedings are pending: interim maintenance (on an ex-parte basis in urgent cases), exclusive use of the family home, or orders preserving marital assets, including cases involving undisclosed assets or corporate holdings. Strict time limits apply; in particular, an application for the division of marital property must be filed within three years of the dissolution of the marriage.
